OWNERSHIP OF PLANS – Unless otherwise agreed to by MetalBoatKits in writing the Owner is authorized to build only ONE vessel from the design. Drawings and Specifications are supplied as instruments of service only and are owned by and shall remain the property of The Designer whether the Project for which they are purchased is executed or not. NO resale or sharing of our plans or CNC Files are permitted under any circumstances without written consent. The design itself remains the exclusive property of Rick Welin.  Rick Welin / MetalBoatKits has the sole right to authorize use of plans or files.

Additional hulls may be licensed for 50% of the original fee. Please contact us regarding additional builds prior to use of our files so that we may authorize use and issue licensing documents.

The Owner shall be permitted to retain copies of Assembly Drawings and Specifications for information and reference only in connection with the Owner’s use for maintenance, repair, and operation of the completed vessel.  Upon completion of the vessel all Plans and Specifications used by the Builder during construction shall be returned to the Designer or destroyed. All computer files such as CNC Nests, AutoCAD Drawings, must be deleted upon completion of the vessel. Without exception, any distribution, reuse, or sharing of these files will be met with the full extent of international copyright law.

* In some cases, with our larger vessel designs, and commercial vessels, the CNC file will be provided directly to the cutting shop on behalf of the builder/owner with the understanding they will not release or re-use the file in any way. In this case we will deal directly with the cutting shop of your choice on your behalf.

MODIFICATIONS: The Designer must be presented with copies of all Change Orders issued which result in the modification of the vessel in any way from the original Construction Documents.  No major changes, omissions, or other variations from the Construction Documents or CNC Files shall be made without the permission of the Designer. (Such permissions will not be unreasonably withheld). No such changes shall be considered approved by the Designer unless agreed to in writing by the Designer.  The Designer may bill the Owner for time spent on such items as above. The Designer is not responsible for modifications by builders or their agents.

DERIVATIVES: Any boat or design derived from our designs through scaling up or down, or the addition, subtraction, or modification of existing parts, or by any other means, shall still be considered a design by Rick Welin, and this agreement will apply to the modified design. Including the requirement for unique Hull Identification Numbers, Certificates Of Authenticity and payment of royalties.

LIABILITIES: The client/purchaser agrees to: 1) Accept the risk of all deficiencies in the yacht or boat whether caused by the designer’s error or omission or that of the Builder. 2) or in the case of custom designs; Bear the cost of “errors and omissions” or “builders risk” insurance covering the design and construction phases of their project.

The client/purchaser agrees to release Rick Welin, MetalBoatKits, and its officers, employees and subcontractors from liability, suits or causes of action arising out of, or relating to the yacht or boat design, supplied plans, or CNC files.

PAYMENTS & INVOICING: Invoices are due upon receipt. An interest rate of 2% per month will be applied to all overdue payments.
